Insurance Informer: Mauritian Supreme Court awards unprecedent damages in a road accident claim
In the recent judgment of Moollan I. v Mosaheb M. & Ors 2023 SCJ 34, the Supreme Court of Mauritius awarded more than MUR 200 million to the claimant, who was involved in a road accident. The quantum of this award of damages is unparalleled in the jurisdiction for a claim of this nature.
Andre Robert, Senior Attorney, and Noor Mungur, Attorney, of our Disputes Team collaborated with Erwyn Durman Senior Associate at Webber Wentzel, on an analysis of the determination of the quantum of damages by the Supreme Court in this landmark case. We thank the Webber Wentzel team for this collaboration opportunity.
