International arbitration continues to expand in Mauritius. In 2023, we have experienced an increase in disputes under the International Arbitration Act 2008 with various judgments being delivered by the Supreme Court of Mauritius and the Judicial Committee of the Privy Council, bringing clarity and transparency to international arbitration in the Mauritian context. This reflects the increase in the number of disputes being resolved by arbitration globally and a positive and continuous pro-enforcement stance can be seen.
The new international arbitration guide 2023 provides an update on the current law on International arbitration encompassing subjects such as key industries in which international arbitration has become prevalent, the governing law, the approach of national courts regarding arbitration agreements, jurisdiction issues, preliminary and interim reliefs available, the procedure, the review and enforcement of arbitral awards illustrated with recent caselaw.
